A Boulder District Court judge on Thursday dismissed Xcel Energy Inc.’s lawsuit against the Boulder City Council over its decision in May 2014 to create a new city-owned utility, saying the utility missed a deadline in filing its challenge.
Xcel (NYSE: XEL) filed its suit 28 days after the city council voted May 6, 2014 to pursue a new city-owned utility and kick the larger, investor-owned utility out of the city.
